Terms & Conditions

What to include in the T&C document

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.

  • Introduction: Briefly state the purpose of the document and that by using your services/purchasing products, the buyer agrees to these terms. Define key terms like "Seller," "Buyer," "Goods," and "Price".

  • Products and Orders:

    • Product Descriptions: Clarify that as items are handmade, slight variations in color, size, or design may occur compared to website photos.

    • Pricing and Payment: Detail accepted payment methods, prices, and any additional costs such as shipping, packaging, and taxes.

    • Order Acceptance: State your right to accept or decline any order.

    • Minimum Orders/Wholesale: If applicable, specify minimum order requirements for wholesale accounts.

  • Shipping and Delivery:

    • Processing and Shipping Times: Provide estimated timelines for order processing and delivery, especially noting potential variations for custom orders.

    • Risk of Loss: State when the risk of loss for items passes to the buyer (e.g., upon shipment).

  • Returns, Refunds, and Cancellations:

    • General Returns: Clearly state your return policy, timeframes for returns, and conditions for accepted items (e.g., undamaged).

    • Custom Orders: Specify if custom or personalized cards are non-returnable/non-refundable.

    • Return Shipping Costs: Indicate who is responsible for return shipping costs (e.g., the buyer if they simply changed their mind).

  • Intellectual Property & Copyright: This is crucial for creative businesses.

    • Ownership of Designs: Explicitly state that all designs, graphics, and card artwork are your intellectual property.

    • Restrictions on Use: Prohibit customers from copying, reproducing, reselling, or creating derivative works of your designs without a commercial license.

    • Commercial Use/Licensing: If you use third-party graphics or stamps, mention that the buyer's use of the final product may be limited by the original artist's terms (e.g., personal use only, not for commercial resale).

  • User Conduct & Website Use: Rules for interacting with your website or service, such as not using the site for unlawful purposes or market research for a competitor.

  • Disclaimer of Warranties: A standard legal clause stating that products and services are provided "as is," with certain limitations.

  • Limitation of Liability: A clause that limits the amount of financial responsibility your company has in case of a problem or dispute.

  • Governing Law & Dispute Resolution: The jurisdiction whose laws govern the agreement and the process for resolving any disputes.

  • Privacy Policy Link: Reference and link to your separate, detailed Privacy Policy.

  • Contact Information: Provide clear details for customers to contact you.
